Sub: Release of Pension for Petitioners and Non-Petitioners of Category 3

Dear Prof Tyagi,
While we welcome the decision taken by DU Administration to release the pensions of Petitioners as well as Non-Petitioners of Category 3, we fail to understand why, for the latter, a three- member committee of the Governing Body has to be set up, whereas for the former, a letter from the Principal was sufficient. Apart from the fact that even the Governing Body Committee would have to rely on the records of the college as certified by the Principal, there is no justification for having a different administrative procedure for the Non-Petitioners as compared to the Petitioners, both being employees of the same institution.
In any case, you are aware of the fact that many colleges do not have full Governing Bodies, and therefore the condition that the three members of the committee should have no connection with the College is impossible to achieve. The new procedure laid down seems designed to delay matters for those who have already had to wait for far too long for something that is theirs by right, and has a crucial bearing on their very survival.
We appeal to you to have this condition (of the GB committee) waived for Non-petitioners of Category 3 who are legally entitled to the same benefits that have been granted by the Hon'ble Division Bench to Category 3. An affidavit by the Principal should suffice.
We may add that, for those of the options category who had been granted pension scheme by DU itself through twelve options given between 1987 and 1998, and who retired after May 2014, pension has still not been released. We fail to understand why Delhi University continues to hold up the pensions of this category of teachers, when neither the Hon'ble High Court nor the MHRD/UGC has given any directions to do so. It may be noted that in its recent SLP-1, para M on page157-158, Delhi University has itself stated that "both the UGC and GoI had approved the extensions made so far" (referring to the options given by DU till 1998). Thus, we appeal to you to release the pensions of those in the options category without any further delay.
